Attorney Alina Habba told a judge in a letter that writer E. Jean Carroll’s trial was ruined when Habba elicited from Carroll through her questions that Carroll had deleted an unknown number of social media messages containing death threats. That jury awarded Carroll $5 million in damages. Robbie Kaplan, an attorney for Carroll who is not related to the judge, declined comment. Habba asked the judge to instruct the jury that Carroll had an obligation to minimize the effect of the defamation she endured. The trial resumes Monday, when Trump will have an opportunity to testify after Carroll's lawyers finish presenting their case.

A federal appeals court on Wednesday denied a bid by Donald Trump to delay a defamation lawsuit by the writer E. Jean Carroll, but granted him an expedited appeal on the question of whether he can claim absolute presidential immunity as a defense. Barring further action by that appeals court or the Supreme Court, the second of Carroll's suits remains scheduled for trial in mid-January in U.S. District Court in Manhattan. In the pending suit headed to trial, Carroll alleges Trump defamed her in 2019 when he, as president, first made statements denying her claim of rape. The DOJ also noted that Trump's allegedly defamatory statements about Carroll continued after he left the White House in January 2021.

"Oh yes he did, oh yes he did," Caroll said during a CNN interview on May 10, reiterating her allegation that Trump raped her. A day earlier, a jury in U.S. District Court Manhattan awarded Carroll $5 million in damages from Trump. Kaplan also said four out of the five statements Trump claimed were defamatory were made outside of New York's one-year statute of limitations. Trump's lawyers argued the $2 million in damages awarded to Carroll are "grossly excessive under applicable case law." Carroll's attorney in a statement scoffed at Trump's argument, and noted the jury unanimously found he sexually abused Carroll. "Trump now argues that, even if he did those things, Ms. Carroll doesn't deserve the $5 million in damages that the jury awarded," said Carroll's lawyer, Robbie Kaplan. A judge denied Donald Trump's bid to delay E. Jean Carroll's rape trial because of his indictment. Judge Lewis A. Kaplan expressed concern the request was "another delay tactic" by the former president. US District Judge Lewis A. Kaplan said some of the so-called media frenzy had been caused by Trump himself. The judge allowed a brief reopening of discovery but denied Trump's request to delay the trial. Carroll "is now over 79 years of age and is entitled to her day in court just as both parties are entitled to a fair trial," Kaplan wrote.
